Terms of Service

These Terms of Service ("Terms") govern your access to and use of Athos ("Athos," "we," "us," or "our") and the AI fitness and nutrition coaching service we provide (the "Service"). Please also review our Privacy Policy, which explains how we handle your data.
Please read this first
- Athos is a coach, not a doctor. It is not medical advice, and not advice from a licensed physician, registered dietitian, or nutritionist.
- It's built by experts — but it's still AI, and AI can make mistakes. Athos is built with real coaching and nutrition expertise, but its guidance is AI-generated and can be wrong, incomplete, or not right for you.
- Use common sense. Don't do anything that feels unsafe, painful, or beyond your current ability. If something seems off, stop and check with a qualified professional.
- You use Athos at your own risk. You are responsible for what you do with its guidance. We are not responsible for any injury or harm that results from acting on the Service.

1. Acceptance of terms
By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of another person or entity, you represent that you have the authority to bind them to these Terms.
2. Description of service
Athos is a subscription AI coaching platform. It builds and continuously adapts personalized training and nutrition plans, provides real-time coaching, and sends notifications and reminders based on the context you share. The Service uses automated, AI-driven systems to generate its guidance. Features may change, improve, or be discontinued over time.
3. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older and are legally able to enter into these Terms.
4. Accounts & security
You are responsible for the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. Notify us promptly if you suspect any unauthorized use. We may suspend or terminate accounts that violate these Terms or pose a security risk.
5. Subscription, billing & refunds
The Service is offered on a subscription basis at $50 per month. As part of the coaching model, you may earn back up to $25 as a rebate against your subscription by hitting verified goals during a billing period.
Subscriptions renew automatically at the then-current price until you cancel. You may cancel at any time; cancellation takes effect at the end of the current billing period, and you will retain access until then. Except where required by law, payments are non-refundable other than through the rebate mechanic described here.
Illustrative / placeholder: The pricing, the up-to-$25 rebate, the criteria for "verified goals," and the mechanics for earning and applying the rebate are illustrative and subject to change. Final billing and refund terms — including how goals are verified, timing of any credit, and eligibility conditions — will be finalized before launch and are to be reviewed by counsel.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Interfere with, disrupt, or overload the Service or its infrastructure;
- Reverse engineer, scrape, or misuse the Service except as permitted by law;
- Provide false information or impersonate another person;
- Upload content that infringes others' rights or that you have no right to share.
7. Health, medical & nutrition disclaimer
Athos is a fitness and nutrition coaching service — not a medical provider, and not a licensed physician, registered dietitian, or nutritionist.
The Service does not provide medical, dietary, or nutritional advice, diagnosis, or treatment, and is not a substitute for professional medical or nutritional care. Consult a physician or qualified healthcare professional before starting any exercise or nutrition program, and especially if you have a medical condition, a dietary restriction or allergy, an eating disorder, are pregnant, are taking medication, or have any concerns about your health. You use the Service, including any workouts, nutrition guidance, and plans, entirely at your own risk and assume all risks associated with physical activity and dietary changes. Stop and seek medical attention if you experience pain, dizziness, or other symptoms.
8. AI-generated content disclaimer
Athos is built with real coaching and nutrition expertise, but its coaching, plans, food analysis, and other guidance are generated by automated AI systems — and AI can make mistakes. Output may be inaccurate, incomplete, outdated, or inappropriate for your situation, and can contain errors or "hallucinations." Use common sense: do not do anything that feels unsafe, painful, or beyond your current ability, and do not rely on the Service as your sole source of information for health, fitness, or nutrition decisions. You are responsible for using your own judgment before acting on any guidance, and you assume the risks of doing so. If something looks wrong, stop and check with a qualified professional — and please tell us so we can fix it.
9. Intellectual property
The Service, including its software, design, text, and branding, is owned by Athos or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms. You retain ownership of the content you provide (such as your logs and photos) and grant us a license to use it to operate and improve the Service as described in our Privacy Policy.
10. Third-party services & agents
The Service integrates third-party providers (including AI, storage, and observability providers) to function. In addition, you may choose to connect your own AI agents or tools to the Service. Your use of any third-party service or agent is subject to that provider's terms, and we are not responsible for third-party products, agents, or content. Connecting an agent may involve sharing your data with that agent; you are responsible for what you connect and authorize.
11. Disclaimers of warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY RESULTS OR GOALS WILL BE ACHIEVED.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATHOS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PERSONAL INJURY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify and hold harmless Athos and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, your connected agents, or your violation of these Terms or applicable law.
14. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by law, or to protect the Service and its users. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
15. Changes to terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
16. Governing law
These Terms are governed by the laws of [Jurisdiction — placeholder, to be finalized with counsel], without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in that jurisdiction, unless otherwise required by applicable law.
